1. Introduction

Welcome to PostPilo. These Terms of Service govern your use of our social media scheduling and management platform and website. PostPilo helps you schedule, automate, and refine social media posts across multiple platforms. By accessing or using PostPilo, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2. Accounts

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.

3. Service Usage

Our service allows you to schedule, manage, and post content across multiple social media platforms including X (Twitter), Reddit, Facebook, LinkedIn, Instagram, and Threads. You are responsible for all content that you schedule and post through our service, including its legality, reliability, and appropriateness. You must comply with the terms of service and community guidelines of each social platform when using PostPilo to schedule or post content.

By using our service to schedule and post content, you authorize us to publish that content to your connected social media accounts on your behalf. You retain all rights to the content you submit, and you are responsible for ensuring you have the right to post such content to the respective platforms. We do not claim ownership of your content.

4. Subscriptions and Plans

Our service is billed on a subscription basis with different tiers (Starter, Pro, and Advanced) offering varying features and capabilities. Each plan includes different feature sets:

• Starter Plan: Basic scheduling and posting features. Does not include access to the Hub or Advanced AI features.
• Pro Plan: Includes all Starter features plus access to the Hub and Advanced AI features.
• Advanced Plan: Includes all Pro features plus additional capabilities and higher usage limits.

You will be billed in advance on a recurring basis, depending on the billing cycle you select (monthly or yearly). Payment is processed securely through our third-party payment processor (Polar). By subscribing, you authorize us to charge your payment method for the plan you selected. Your subscription will automatically renew under the exact same conditions unless you cancel it or PostPilo cancels it.

5. Free Trial

PostPilo offers a 7-day free trial for new users. You may be required to enter your billing information to sign up for the free trial. If you do enter your billing information when signing up for a free trial, you will not be charged by PostPilo until the free trial has expired. If you do not wish to continue with a paid subscription after your trial, you must cancel before the trial period ends to avoid being charged.

6. Feature Access and Restrictions

Access to certain features is restricted based on your subscription plan:

• The Hub and Advanced AI features are only available to users on Pro and Advanced plans.
• All plans include basic scheduling and posting capabilities across supported social platforms.
• Usage limits (such as number of scheduled posts, connected accounts, or content creation) may vary by plan.

We reserve the right to modify, suspend, or discontinue any feature or aspect of our service at any time, with or without notice.

7. Intellectual Property

The service and its original content, features and functionality (including but not limited to our AI content creation and refinement tools, scheduling algorithms, and platform integrations) are and will remain the exclusive property of PostPilo and its licensors. The service is protected by copyright, trademark, and other applicable laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PostPilo.

8. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms, violation of social platform policies, or engaging in abusive or harmful practices such as spamming or posting inappropriate content.

9. Limitation of Liability

In no event shall PostPilo, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service. This includes any damages resulting from actions taken by social platforms in response to content posted through our service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
